1. Contractual conclusion
The representation of the products in the online shop does not constitute a legally binding offer, but an invitation for ordering. All prices subject to change. Subject to color, shape and technically-induced changes which do not impair the intended use. Upon clicking the “Send order” button, you are submitting a binding offer to buy. Order confirmation is immediately effected upon submission of the order. The sales contract comes into effect upon mailing of the order confirmation.
The sales contract can be concluded in German, English, French, Spanish or Italian.
2. Delivery and shipping costs
Deliveries are effected worldwide. Also for deliveries to foreign countries, the concluded sales contract is subject to German law. Joana Leyer is at all times entitled to effect partial deliveries. In case of partial deliveries, the additional shipping costs are borne by Joana Leyer.
3. Prices and payment
All prices are stated in Euro. For deliveries inside the EU, all prices contain the legal value-added tax. Deliveries outside the EU are shipped tax-free and duty unpaid. Payment is effected by wire transfer, direct debiting, PayPal, credit card (Visa, Mastercard / Eurocard) or advance payment; within Germany, also purchase on account is possible.
Debiting of your credit card account, current account or PayPal account is effected upon completion of the order.
4. Withdrawal instructions
4.1. Right of withdrawal
You may withdraw your contractual declaration without any statement of reason within two weeks in writing (e.g. letter, fax, e-mail) or – if the goods are supplied to you prior to expiry of this period – by return shipment of the goods. The period commences upon receipt of these instructions in writing. The timely submission of the notice of withdrawal or return shipment of the goods suffices for compliance with the withdrawal period. The notice of withdrawal is to be addressed to:

4.2. Withdrawal consequences
In case of an effective withdrawal, the goods and services received by either party shall be returned and, if necessary, restitution shall be made for capitalized use (e.g. interest). Should you not be able to return the received goods and services completely or only in part or in a deteriorated condition, you shall be obliged to compensate the respective lost value.
This shall not apply to the surrender of goods if the deterioration of such goods is solely attributable to their examination, as would have been possible in a retail shop for example. Furthermore, you can avoid such obligation to compensate any lost value due to the goods’ deterioration as a result of their utilization for their intended use by not using the goods as your property and by refraining from all actions which may impair their value. Goods capable of being shipped by parcel shall be returned to us at our costs and risk. Goods which are not capable of being shipped by parcel will be collected from your premises. Obligations regarding the reimbursement of payments shall have to be met within 30 days. For you, this period commences upon submission of your notice of withdrawal; for us, this period commences upon receipt of such notice of withdrawal.

5. Reservation of title
The delivered goods remain in the seller’s ownership until their full payment.
6. Transportation damage, notification of defects and warranty
Transportation damage must be complained to and confirmed by the freight carrier or the freight forwarding agency. Shipments with unpaid or only partially paid freight will not be accepted. In case of justified complaints, the freight costs will be reimbursed to you. Defects must be notified to us in writing within 8 days at the latest. Minor customary or technically unavoidable deviations in terms of quality, color, dimension, weight, etc., must not be complained. In case of justified complaints, the seller is entitled to request one of the following remedies: subsequent improvement free of charge and / or partial or complete exchange or remuneration of the invoice amount for defective items.
7. Data protection
Joana Leyer saves personal data for the purpose of order processing; in case of online payment (PayPal, Saferpay), such data is forwarded to the respective payment service provider.
According to the German data protection act (Bundesdatenschutzgesetz), you are entitled to free disclosure of your saved data and, if applicable, you are entitled to have such data corrected, blocked or deleted.
Upon subscription to the newsletter and subject to you acceptance, your e-mail address will be used for our advertising purposes.
This contractual text is saved by us and we will send your order data and our GTC to you by e-mail. The GTC can also be accessed here at all times. You can call up your previous orders in our customer login section.
8. Further provisions
Should individual provisions of the above-stated general terms and conditions (GTC) be or become void, the remaining provisions of the general terms and conditions (GTC) shall not be affected thereby. Such void provision shall be replaced by the legal regulations.
